It should not be incumbent on users to understand how machine learning works. Being well informed does not demand that everyone know everything. There is to much to know and machine learning is a narrow specialty. I expect my doctor to know more about medicine than I do. I expect them to be competent and if they cause harm to provide compensation. The same should apply to Twitter and Facebook and Google and Amazon but they require we waive our rights as part of the user agreements. I believe those agreements are invalid. You could sign a waiver when you rent a jet ski but it is not worth the paper it is written on, they have obligations that you cannot waive. The same is true of Tech companies but then they have the money and lawyers to win in court even if they are wrong.
