It would have to be wealth; the rich hide their income, so they don't have to pay taxes either.

I am not sure about how to punish the poor. You can't let them off with no punishment but taking money from someone with absolutely no wealth only unbearable debt seems like the wrong answer. Jail time or community service still makes it harder for them to support their families or themselves.
