Not true, if the common carrier is aware of and/or encourages illegal behavior to enrich its bottom line. If I am illegally shipping drugs or explosives and UPS knows it but looks the other way so as to not lose my business., they are not immune from prosecution. If someone reported to Pavel that they had evidence and provided evidence that a certain account was distributing illegal information or coordinating a terrorist attack and Pavel took no action, I think he is open for a reasonable prosecution. Free speech is not absolute, at least not in the U.S.A. and should not be. It is a fact that some speech, expression, information, is illegal. Knowingly facilitating the distribution of illegal speech, expression, information, is criminal. A more poisonous charge would be that not only did Telegram not stop illegal communications it was fully aware of but that maybe Pavel was actually one of the persons creating these illegal communications. Having not seen the evidence or the actual charges, we have to wait and see.
